Acceptable Use Policy

This Acceptable Use Policy ("Policy") governs the use of the software and services provided by DynaPictures GmbH ("Provider"), including in particular the AI image generation features. It supplements and forms part of the Terms of Use. Capitalised terms have the meaning given in the Terms of Use. By using the services, The Customer and its users agree to this Policy.

§ 1 Scope

1. This Policy applies to all use of the Provider's services and to all content generated, uploaded, processed or distributed through them, including prompts, source images, reference images and AI Output.

2. The Provider's AI image generation features are powered by third-party AI model providers. The Customer's use must also comply with the applicable usage policies of those providers. This Policy is intended to satisfy the Provider's obligation to bind its users to an acceptable use policy.

§ 2 Prohibited Content and Uses

The Customer must not use the services, and in particular the AI image generation features, to create, upload, generate, store or distribute content that:

1. infringes the intellectual property, copyright, trademark, trade dress or other proprietary rights of any third party, including by reproducing third-party logos, brands, watermarks or recognisable copyrighted works;

2. depicts a real, identifiable person without the rights or consent required under applicable personality, publicity, image or data protection law, including the creation of "deepfakes" or synthetic media that could be mistaken for a real person;

3. is sexual content involving minors, non-consensual intimate imagery, or any sexually explicit material in breach of applicable law or the AI providers' policies;

4. is violent, hateful, harassing, discriminatory, or promotes self-harm, terrorism or illegal activities;

5. is deceptive or misleading in a commercial or advertising context, including imagery that misrepresents a product, service, event or person, or that is likely to deceive consumers;

6. constitutes political disinformation, election manipulation, or impersonation of public figures, officials or organisations;

7. is unlawful, defamatory, or otherwise violates applicable law in any jurisdiction where the content is generated or used.

§ 3 Transparency and Labeling

1. The Customer is responsible for disclosing and labeling AI-generated or AI-manipulated content where required by applicable law, including the transparency obligations under the EU AI Act, advertising standards and consumer protection law.

2. The Customer must not remove, alter or obscure any provenance information, watermark or content credential applied by an AI provider or by the Provider, where doing so would breach applicable law.

§ 4 Rights of the Customer in Inputs and Output

1. The Customer warrants that it holds all rights necessary to the prompts, source images and reference images it provides, and is solely responsible for the lawful use of AI Output, as set out in § 7 of the Terms of Use.

§ 5 Enforcement

1. The Provider may, at its discretion, review usage for compliance with this Policy, rely on the content moderation of its AI providers, and remove or disable access to content that violates this Policy.

2. In the event of a breach of this Policy, the Provider reserves the right to suspend or terminate access to the services in whole or in part, immediately and without prior notice, in accordance with § 5 of the Terms of Use.

3. The Customer indemnifies the Provider against third-party claims arising from a breach of this Policy, as set out in § 7 of the Terms of Use.

§ 6 Changes to this Policy

1. The Provider may update this Policy in line with changes to applicable law, the services, or the policies of its AI providers. The current version is always available at https://dynapictures.com/p/acceptable-use.
